Terms of Service

These Terms of Service ("Terms") govern your use of www.amplifyecomm.com (the "Site"), operated by Amplify eComm LLC ("we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Our services

Amplify eComm provides eCommerce advisory and management services for consumer brands, including Fractional Executive Leadership, full-service Amazon Channel management, and account audits. Content on the Site describes those services for general information only. Client engagements are governed by separate written agreements; if a written agreement conflicts with these Terms, the written agreement controls for that engagement.

2. No guarantees; not professional advice

Case studies, statistics, and track records on the Site describe past work in specific contexts, including work our executives performed in prior roles at other organizations. Past results do not guarantee future outcomes, and nothing on the Site is a promise of specific revenue, ranking, profitability, or growth results. Content on the Site is not legal, tax, financial, or investment advice.

3. Intellectual property

The Site and its content (including text, graphics, logos, and the Amplify flywheel mark) are owned by Amplify eComm or its licensors and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive license to view the Site for your personal or internal business use. You may not copy, modify, distribute, or create derivative works from Site content without our prior written permission. Trademarks of third parties referenced on the Site belong to their respective owners.

4. Acceptable use

  • Do not use the Site in any way that violates applicable law.
  • Do not attempt to gain unauthorized access to the Site or interfere with its operation.
  • Do not use automated means to scrape or harvest content or data from the Site, except as permitted for standard search-engine indexing.
  • Do not submit false or misleading information through our forms.

5. Third-party services and links

The Site links to third-party services, including our scheduling provider. Those services are governed by their own terms and policies, and we are not responsible for their content or practices.

6. Disclaimer of warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

7. Limitation of liability

To the maximum extent permitted by law, Amplify eComm will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or relating to your use of the Site. To the maximum extent permitted by law, our total liability for claims relating to the Site will not exceed one hundred U.S. dollars. This section does not limit any liability that cannot be limited under applicable law, and it does not apply to client engagements, which are governed by their own written agreements.

8. Indemnification

You agree to indemnify and hold Amplify eComm harmless from claims arising out of your misuse of the Site or your violation of these Terms.

9. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Venue for disputes under these Terms is Los Angeles County, California.

10. Changes to these Terms

We may update these Terms from time to time. The revised version takes effect when posted on this page with an updated effective date. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
